Terms of Service

1. Acceptance
By creating an account or using appiana.com (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
Appiana provides AI-assisted application building tools and related services on a tiered subscription basis. We may change, suspend, or discontinue parts of the Service at any time with reasonable notice.
3. Accounts
You must be at least 16 years old. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at hello@appiana.com of any unauthorized use.
4. Plans, billing, and refunds
Plans available: Beginner ($5), Medium ($15), Pro ($25), Prestige ($60). Charges are processed by Stripe. Higher tiers receive faster build lanes and more frequent product updates. Each checkout charges the listed amount once. Unless required by law, payments are non-refundable. You may cancel and stop further charges from your account at any time.
5. Acceptable use
You agree not to: (a) use the Service for unlawful purposes; (b) attempt to break, probe, or reverse-engineer the Service; (c) generate or distribute malware, spam, or content that violates third-party rights; (d) abuse rate limits or evade billing.
6. Your content
You retain ownership of code, prompts, and content you create using the Service. You grant us a limited license to store and process your content solely to operate and improve the Service.
7. Our intellectual property
The Service, including the appiana.com brand, the "Made by jmelodie" mark, the UI, and the underlying code, is owned by us and protected by intellectual-property laws. You receive only the limited right to use the Service per these Terms.
8. Termination
We may suspend or terminate your account for material breach of these Terms or for fraud, chargeback abuse, or illegal activity. You may close your account at any time.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
11. Indemnity
You agree to defend and indemnify us against any third-party claim arising from your use of the Service or breach of these Terms.
12. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. You and we agree that any dispute arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
13. Changes
We may update these Terms. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance of the updated Terms.
